{"id":22350,"date":"2025-11-07T07:00:28","date_gmt":"2025-11-07T07:00:28","guid":{"rendered":"https:\/\/areton-ltd.com\/?page_id=22350"},"modified":"2026-01-12T14:35:27","modified_gmt":"2026-01-12T14:35:27","slug":"opposition-to-proposed-article-4-direction-and-selective-licensing-east-marsh-grimsby-4","status":"publish","type":"page","link":"https:\/\/areton-ltd.com\/es\/opposition-to-proposed-article-4-direction-and-selective-licensing-east-marsh-grimsby-4\/","title":{"rendered":"Opposition to Proposed Article 4 Direction and Selective Licensing \u2013 East Marsh, Grimsby"},"content":{"rendered":"<p data-start=\"397\" data-end=\"471\"><strong data-start=\"397\" data-end=\"424\">Published by Areton Ltd<\/strong><br data-start=\"424\" data-end=\"427\" \/><em data-start=\"427\" data-end=\"469\">Public Policy Submission \u2013 November 2025<\/em><\/p>\n<hr data-start=\"473\" data-end=\"476\" \/>\n<h3 data-start=\"478\" data-end=\"501\">\ud83d\udcc4 <strong data-start=\"485\" data-end=\"501\">Introducci\u00f3n<\/strong><\/h3>\n<p data-start=\"503\" data-end=\"656\">This page presents Areton Ltd\u2019s formal submission opposing the proposed <strong data-start=\"575\" data-end=\"629\">Article 4 Direction and selective licensing scheme<\/strong> for East Marsh, Grimsby.<\/p>\n<p data-start=\"658\" data-end=\"859\">We have provided <strong data-start=\"675\" data-end=\"740\">evidence of derelict, boarded-up, and long-term vacant houses<\/strong> across East Marsh to demonstrate that the real issue facing the area is <strong data-start=\"813\" data-end=\"835\">disuse and neglect<\/strong>, not HMO development.<\/p>\n<p data-start=\"861\" data-end=\"907\">The full letter below has been submitted to:<\/p>\n<ul data-start=\"908\" data-end=\"1067\">\n<li data-start=\"908\" data-end=\"998\">\n<p data-start=\"910\" data-end=\"998\"><strong data-start=\"910\" data-end=\"929\">Planning Policy<\/strong> y <strong data-start=\"934\" data-end=\"954\">Housing Strategy<\/strong> teams \u2013 <em data-start=\"963\" data-end=\"996\">North East Lincolnshire Council<\/em><\/p>\n<\/li>\n<li data-start=\"999\" data-end=\"1067\">\n<p data-start=\"1001\" data-end=\"1067\"><strong data-start=\"1001\" data-end=\"1065\">Secretary of State for Levelling Up, Housing and Communities<\/strong><\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1069\" data-end=\"1192\">We will continue to publish additional photographic and video evidence of East Marsh dereliction as it becomes available.<\/p>\n<hr data-start=\"1194\" data-end=\"1197\" \/>\n<hr data-start=\"1597\" data-end=\"1600\" \/>\n<h4 data-start=\"1602\" data-end=\"1628\"><\/h4>\n<p data-start=\"1630\" data-end=\"1946\">I write as a property investor and stakeholder active in the regeneration of East Marsh and Cleethorpes, within the North East Lincolnshire Council area.<br data-start=\"1783\" data-end=\"1786\" \/>I am deeply concerned about the ongoing discussion of introducing an <strong data-start=\"1855\" data-end=\"1887\">Article 4 Direction for HMOs<\/strong> and expanding <strong data-start=\"1902\" data-end=\"1925\">selective licensing<\/strong> across East Marsh.<\/p>\n<p data-start=\"1948\" data-end=\"2103\">These measures, while perhaps well-intentioned, would in practice <strong data-start=\"2014\" data-end=\"2102\">discourage investment, prolong vacancy, and worsen an already fragile housing market<\/strong>.<\/p>\n<hr data-start=\"2105\" data-end=\"2108\" \/>\n<h3 data-start=\"2110\" data-end=\"2171\">\ud83e\uddf1 <strong data-start=\"2117\" data-end=\"2171\">1. The Real Problem Is Derelict Housing \u2013 Not HMOs<\/strong><\/h3>\n<p data-start=\"2173\" data-end=\"2478\">The principal issue in East Marsh is the sheer volume of <strong data-start=\"2230\" data-end=\"2272\">empty, boarded-up, and derelict houses<\/strong>, not a proliferation of HMOs.<br data-start=\"2302\" data-end=\"2305\" \/>A short walk along <strong data-start=\"2324\" data-end=\"2341\">Harold Street<\/strong>, <strong data-start=\"2343\" data-end=\"2364\">Wellington Street<\/strong>, <strong data-start=\"2366\" data-end=\"2385\">Brereton Avenue<\/strong>, <strong data-start=\"2387\" data-end=\"2405\">Rutland Street<\/strong>, and <strong data-start=\"2411\" data-end=\"2429\">Weelsby Street<\/strong> shows rows of vacant and neglected properties.<\/p>\n<p data-start=\"2480\" data-end=\"2747\">This decay is the result of <strong data-start=\"2508\" data-end=\"2536\">chronic under-investment<\/strong>, not over-development.<br data-start=\"2559\" data-end=\"2562\" \/>Investment should be <strong data-start=\"2583\" data-end=\"2612\">encouraged, not red-taped<\/strong>. The Council should prioritise bringing these homes back into use instead of adding barriers that make such work financially unviable.<\/p>\n<hr data-start=\"2749\" data-end=\"2752\" \/>\n<h3 data-start=\"2754\" data-end=\"2812\">\ud83d\udcb7 <strong data-start=\"2761\" data-end=\"2812\">2. Freedom from Article 4 Supports Regeneration<\/strong><\/h3>\n<p data-start=\"2814\" data-end=\"3115\">The absence of an Article 4 Direction in East Marsh is one of the few reasons investors still risk purchasing and refurbishing older housing stock.<br data-start=\"2961\" data-end=\"2964\" \/><strong data-start=\"2964\" data-end=\"2996\">Permitted development rights<\/strong> allow homes that would otherwise remain abandoned to be restored and turned into affordable, liveable accommodation.<\/p>\n<p data-start=\"3117\" data-end=\"3312\">If Article 4 restrictions were introduced, this regeneration would <strong data-start=\"3184\" data-end=\"3205\">stall immediately<\/strong>.<br data-start=\"3206\" data-end=\"3209\" \/>Costs would rise, project feasibility would collapse, and many properties would remain empty for years.<\/p>\n<hr data-start=\"3314\" data-end=\"3317\" \/>\n<h3 data-start=\"3319\" data-end=\"3386\">\u2696\ufe0f <strong data-start=\"3326\" data-end=\"3386\">3. A Borough-Wide Article 4 Would Breach National Policy<\/strong><\/h3>\n<p data-start=\"3388\" data-end=\"3452\">La <strong data-start=\"3392\" data-end=\"3437\">National Planning Policy Framework (NPPF)<\/strong> is explicit:<\/p>\n<blockquote data-start=\"3454\" data-end=\"3775\">\n<p data-start=\"3456\" data-end=\"3775\">\u201cThe use of Article 4 directions \u2026 should be limited to situations where this is necessary to protect local amenity or the well-being of the area \u2026 The potential harm that the direction is intended to address should be clearly identified. Article 4 directions should apply to the smallest geographical area possible.\u201d<\/p>\n<\/blockquote>\n<p data-start=\"3777\" data-end=\"4065\">Any <strong data-start=\"3781\" data-end=\"3818\">borough-wide or blanket Article 4<\/strong> covering North East Lincolnshire would contradict government policy.<br data-start=\"3887\" data-end=\"3890\" \/>Unless the Council can show that every ward faces identical HMO-related harm \u2014 which it cannot \u2014 such a Direction would be <strong data-start=\"4013\" data-end=\"4064\">modified or cancelled by the Secretary of State<\/strong>.<\/p>\n<hr data-start=\"4067\" data-end=\"4070\" \/>\n<h3 data-start=\"4072\" data-end=\"4146\">\ud83e\uddfe <strong data-start=\"4079\" data-end=\"4146\">4. No Evidence That HMOs Cause Problems \u2013 In Fact, the Opposite<\/strong><\/h3>\n<p data-start=\"4148\" data-end=\"4293\">Assertions that HMOs cause anti-social behaviour or degrade neighbourhoods are <strong data-start=\"4227\" data-end=\"4254\">unsupported by evidence<\/strong>.<br data-start=\"4255\" data-end=\"4258\" \/>In reality, the opposite is true:<\/p>\n<ol data-start=\"4295\" data-end=\"4577\">\n<li data-start=\"4295\" data-end=\"4366\">\n<p data-start=\"4298\" data-end=\"4366\">HMOs are already tightly regulated under the <strong data-start=\"4343\" data-end=\"4363\">Housing Act 2004<\/strong>.<\/p>\n<\/li>\n<li data-start=\"4367\" data-end=\"4460\">\n<p data-start=\"4370\" data-end=\"4460\">Smaller HMOs (3\u20134 occupants) remain under <strong data-start=\"4412\" data-end=\"4457\">environmental health and tenancy controls<\/strong>.<\/p>\n<\/li>\n<li data-start=\"4461\" data-end=\"4577\">\n<p data-start=\"4464\" data-end=\"4577\">The claim of housing shortage is false for East Marsh. There is <strong data-start=\"4528\" data-end=\"4560\">an abundance of vacant stock<\/strong>, not scarcity.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"4579\" data-end=\"4640\">HMOs are therefore <strong data-start=\"4598\" data-end=\"4639\">part of the solution, not the problem<\/strong>.<\/p>\n<hr data-start=\"4642\" data-end=\"4645\" \/>\n<h3 data-start=\"4647\" data-end=\"4711\">\ud83d\udeab <strong data-start=\"4654\" data-end=\"4711\">5. Any Article 4 for East Marsh Would Be Indefensible<\/strong><\/h3>\n<p data-start=\"4713\" data-end=\"4969\">If the Council proposed an Article 4 Direction for East Marsh, it would be <strong data-start=\"4788\" data-end=\"4809\">easily challenged<\/strong>.<br data-start=\"4810\" data-end=\"4813\" \/>Photographic and video evidence of the numerous boarded-up homes would prove that the area suffers from <strong data-start=\"4917\" data-end=\"4948\">disuse and under-investment<\/strong>, not HMO pressure.<\/p>\n<p data-start=\"4971\" data-end=\"5085\">Such a Direction would <strong data-start=\"4994\" data-end=\"5036\">contradict national regeneration goals<\/strong> and could be rejected by the Secretary of State.<\/p>\n<hr data-start=\"5087\" data-end=\"5090\" \/>\n<h3 data-start=\"5092\" data-end=\"5137\">\ud83c\udfd8 <strong data-start=\"5099\" data-end=\"5137\">6. Consequences of Over-Regulation<\/strong><\/h3>\n<p data-start=\"5139\" data-end=\"5201\">Combining Article 4 controls with selective licensing would:<\/p>\n<ul data-start=\"5202\" data-end=\"5392\">\n<li data-start=\"5202\" data-end=\"5255\">\n<p data-start=\"5204\" data-end=\"5255\">Deter legitimate refurbishment and redevelopment.<\/p>\n<\/li>\n<li data-start=\"5256\" data-end=\"5307\">\n<p data-start=\"5258\" data-end=\"5307\">Reduce the supply of affordable shared housing.<\/p>\n<\/li>\n<li data-start=\"5308\" data-end=\"5350\">\n<p data-start=\"5310\" data-end=\"5350\">Leave derelict homes empty for longer.<\/p>\n<\/li>\n<li data-start=\"5351\" data-end=\"5392\">\n<p data-start=\"5353\" data-end=\"5392\">Increase deprivation and urban decay.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5394\" data-end=\"5560\">HMOs are one of the few private-sector models capable of <strong data-start=\"5451\" data-end=\"5501\">reviving long-vacant homes without public cost<\/strong>. Blocking them will worsen East Marsh\u2019s housing condition.<\/p>\n<hr data-start=\"5562\" data-end=\"5565\" \/>\n<h3 data-start=\"5567\" data-end=\"5598\">\ud83d\udce3 <strong data-start=\"5574\" data-end=\"5598\">7. Requested Actions<\/strong><\/h3>\n<ol data-start=\"5600\" data-end=\"6127\">\n<li data-start=\"5600\" data-end=\"5769\">\n<p data-start=\"5603\" data-end=\"5769\"><strong data-start=\"5603\" data-end=\"5662\">Do not make or confirm any Article 4 Direction for HMOs<\/strong> covering East Marsh or the wider borough until the derelict housing-stock issue has been fully resolved.<\/p>\n<\/li>\n<li data-start=\"5770\" data-end=\"5862\">\n<p data-start=\"5773\" data-end=\"5862\"><strong data-start=\"5773\" data-end=\"5823\">Withdraw any plan for a borough-wide Article 4<\/strong>, which would conflict with NPPF \u00a753.<\/p>\n<\/li>\n<li data-start=\"5863\" data-end=\"5965\">\n<p data-start=\"5866\" data-end=\"5965\"><strong data-start=\"5866\" data-end=\"5902\">Prioritise regeneration policies<\/strong> that encourage investment and rehabilitation of empty homes.<\/p>\n<\/li>\n<li data-start=\"5966\" data-end=\"6053\">\n<p data-start=\"5969\" data-end=\"6053\"><strong data-start=\"5969\" data-end=\"6019\">Recognise that HMOs are already well-regulated<\/strong> and provide affordable housing.<\/p>\n<\/li>\n<li data-start=\"6054\" data-end=\"6127\">\n<p data-start=\"6057\" data-end=\"6127\"><strong data-start=\"6057\" data-end=\"6088\">Engage with local investors<\/strong> to support sustainable regeneration.<\/p>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol data-start=\"5600\" data-end=\"6127\">\n<li data-start=\"6054\" data-end=\"6127\">\n<p data-start=\"6057\" data-end=\"6127\">.<\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"6129\" data-end=\"6132\" \/>\n<h3 data-start=\"6134\" data-end=\"6190\">\ud83c\udfda <strong data-start=\"6141\" data-end=\"6190\">8. Evidence of Derelict Housing in East Marsh<\/strong><\/h3>\n<p data-start=\"6192\" data-end=\"6421\">Below are some examples of the <strong data-start=\"6223\" data-end=\"6271\">many boarded-up, long-term vacant properties<\/strong> identified across East Marsh.<br data-start=\"6301\" data-end=\"6304\" \/>These images demonstrate the true condition of the area and the need for private
