Upon careful review of the statutory framework governing HMOs, it is submitted that:<\/p>\n<ul data-start=\"1408\" data-end=\"1918\">\n<li data-start=\"1408\" data-end=\"1470\">\n<p data-start=\"1410\" data-end=\"1470\">There is <strong data-start=\"1419\" data-end=\"1443\">no legislative basis<\/strong> authorising such a demand;<\/p>\n<\/li>\n<li data-start=\"1471\" data-end=\"1545\">\n<p data-start=\"1473\" data-end=\"1545\">The request constitutes an <strong data-start=\"1500\" data-end=\"1522\">unlawful overreach<\/strong> of enforcement powers;<\/p>\n<\/li>\n<li data-start=\"1546\" data-end=\"1719\">\n<p data-start=\"1548\" data-end=\"1719\">The removal would be <strong data-start=\"1569\" data-end=\"1612\">contrary to the landlord\u2019s legal duties<\/strong> under the Housing Act 2004 and the Management of Houses in Multiple Occupation (England) Regulations 2006;<\/p>\n<\/li>\n<li data-start=\"1720\" data-end=\"1918\">\n<p data-start=\"1722\" data-end=\"1918\">Depriving tenants of necessary furniture would <strong data-start=\"1769\" data-end=\"1795\">diminish the usability<\/strong> of the property, <strong data-start=\"1813\" data-end=\"1844\">reduce hygiene and tidiness<\/strong>, and <strong data-start=\"1850\" data-end=\"1870\">increase hazards<\/strong> that landlords are legally required to prevent.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"1920\" data-end=\"1923\" \/>\n<h3 data-start=\"1925\" data-end=\"1957\"><strong data-start=\"1929\" data-end=\"1957\">1. Legislative Framework<\/strong><\/h3>\n<p data-start=\"1959\" data-end=\"2023\">The management and regulation of HMOs are primarily governed by:<\/p>\n<ul data-start=\"2025\" data-end=\"2253\">\n<li data-start=\"2025\" data-end=\"2048\">\n<p data-start=\"2027\" data-end=\"2048\"><strong data-start=\"2027\" data-end=\"2047\">Housing Act 2004<\/strong>;<\/p>\n<\/li>\n<li data-start=\"2049\" data-end=\"2144\">\n<p data-start=\"2051\" data-end=\"2144\"><strong data-start=\"2051\" data-end=\"2125\">Management of Houses in Multiple Occupation (England) Regulations 2006<\/strong> (SI 2006 No. 372);<\/p>\n<\/li>\n<li data-start=\"2145\" data-end=\"2253\">\n<p data-start=\"2147\" data-end=\"2253\"><strong data-start=\"2147\" data-end=\"2198\">Housing Health and Safety Rating System (HHSRS)<\/strong>, as set out in <strong data-start=\"2214\" data-end=\"2228\">Schedule 1<\/strong> of the Housing Act 2004.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2255\" data-end=\"2304\">The relevant duties imposed on landlords include:<\/p>\n<h4 data-start=\"2306\" data-end=\"2388\">a) <strong data-start=\"2314\" data-end=\"2388\">Management of Houses in Multiple Occupation (England) Regulations 2006<\/strong><\/h4>\n<ul data-start=\"2389\" data-end=\"2873\">\n<li data-start=\"2389\" data-end=\"2595\">\n<p data-start=\"2391\" data-end=\"2481\"><strong data-start=\"2391\" data-end=\"2407\">Regulation 6<\/strong>: Requires that common parts (including communal rooms) are maintained in:<\/p>\n<blockquote data-start=\"2484\" data-end=\"2595\">\n<p data-start=\"2486\" data-end=\"2595\"><em data-start=\"2486\" data-end=\"2595\">\u201cgood and clean decorative repair; safe and working condition; and kept reasonably clear from obstruction.\u201d<\/em><\/p>\n<\/blockquote>\n<\/li>\n<li data-start=\"2597\" data-end=\"2873\">\n<p data-start=\"2599\" data-end=\"2645\"><strong data-start=\"2599\" data-end=\"2618\">Regulation 4(3)<\/strong>: Obligates the manager to:<\/p>\n<blockquote data-start=\"2648\" data-end=\"2873\">\n<p data-start=\"2650\" data-end=\"2873\"><em data-start=\"2650\" data-end=\"2873\">\u201ctake all such measures as are reasonably required to protect the occupiers of the HMO from injury, having regard to \u2014 (a) the design of the HMO; (b) the structural conditions in the HMO; and (c) the number of occupiers.\u201d<\/em><\/p>\n<\/blockquote>\n<\/li>\n<\/ul>\n<h4 data-start=\"2875\" data-end=\"2934\">b) <strong data-start=\"2883\" data-end=\"2934\">Housing Health and Safety Rating System (HHSRS)<\/strong><\/h4>\n<p data-start=\"2935\" data-end=\"3009\">The HHSRS requires landlords to assess and mitigate risks associated with:<\/p>\n<ul data-start=\"3010\" data-end=\"3138\">\n<li data-start=\"3010\" data-end=\"3028\">\n<p data-start=\"3012\" data-end=\"3028\">Personal injury,<\/p>\n<\/li>\n<li data-start=\"3029\" data-end=\"3050\">\n<p data-start=\"3031\" data-end=\"3050\">Psychological harm,<\/p>\n<\/li>\n<li data-start=\"3051\" data-end=\"3138\">\n<p data-start=\"3053\" data-end=\"3138\">Lack of adequate living conditions (including overcrowding and insufficient storage).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3140\" data-end=\"3299\">The system explicitly categorizes certain risks as <strong data-start=\"3191\" data-end=\"3202\">hazards<\/strong>, such as overcrowding, stress, and accidents, which landlords are required to avoid or minimize.<\/p>\n<hr data-start=\"3301\" data-end=\"3304\" \/>\n<h3 data-start=\"3306\" data-end=\"3356\"><strong data-start=\"3310\" data-end=\"3356\">2. No Legal Basis for Removal of Furniture<\/strong><\/h3>\n<p data-start=\"3358\" data-end=\"3481\">Nowhere in the <strong data-start=\"3373\" data-end=\"3393\">Housing Act 2004<\/strong>, the <strong data-start=\"3399\" data-end=\"3429\">HMO Management Regulations<\/strong>, or <strong data-start=\"3434\" data-end=\"3443\">HHSRS<\/strong> is there any <strong data-start=\"3457\" data-end=\"3480\">statutory provision<\/strong>:<\/p>\n<ul data-start=\"3483\" data-end=\"3682\">\n<li data-start=\"3483\" data-end=\"3592\">\n<p data-start=\"3485\" data-end=\"3592\"><strong data-start=\"3485\" data-end=\"3498\">Mandating<\/strong> the removal of specific items of furniture such as wardrobes or drawers from communal spaces;<\/p>\n<\/li>\n<li data-start=\"3593\" data-end=\"3682\">\n<p data-start=\"3595\" data-end=\"3682\"><strong data-start=\"3595\" data-end=\"3610\">Authorizing<\/strong> the council to compel a landlord to do so absent a demonstrated hazard.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3684\" data-end=\"3745\">The legislation imposes duties to ensure that communal areas:<\/p>\n<ul data-start=\"3746\" data-end=\"3827\">\n<li data-start=\"3746\" data-end=\"3757\">\n<p data-start=\"3748\" data-end=\"3757\">Are safe,<\/p>\n<\/li>\n<li data-start=\"3758\" data-end=\"3784\">\n<p data-start=\"3760\" data-end=\"3784\">Are free of hazards, and<\/p>\n<\/li>\n<li data-start=\"3785\" data-end=\"3827\">\n<p data-start=\"3787\" data-end=\"3827\">Remain reasonably usable and accessible.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3829\" data-end=\"3953\">There is <strong data-start=\"3838\" data-end=\"3854\">no provision<\/strong> granting the council authority to regulate or dictate the exact contents of a communal room where:<\/p>\n<ul data-start=\"3955\" data-end=\"4120\">\n<li data-start=\"3955\" data-end=\"4007\">\n<p data-start=\"3957\" data-end=\"4007\">The furniture does <strong data-start=\"3976\" data-end=\"4006\">not obstruct escape routes<\/strong>;<\/p>\n<\/li>\n<li data-start=\"4008\" data-end=\"4048\">\n<p data-start=\"4010\" data-end=\"4048\">There is <strong data-start=\"4019\" data-end=\"4037\">no fire hazard<\/strong> presented;<\/p>\n<\/li>\n<li data-start=\"4049\" data-end=\"4120\">\n<p data-start=\"4051\" data-end=\"4120\">The room remains <strong data-start=\"4068\" data-end=\"4104\">functional, safe, and accessible<\/strong> for tenant use.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4122\" data-end=\"4290\">Unless the council can demonstrate that the furniture <strong data-start=\"4176\" data-end=\"4200\">constitutes a hazard<\/strong> under the HHSRS or obstructs safe egress, <strong data-start=\"4243\" data-end=\"4271\">there is no lawful basis<\/strong> for their request.<\/p>\n<hr data-start=\"4292\" data-end=\"4295\" \/>\n<h3 data-start=\"4297\" data-end=\"4363\"><strong data-start=\"4301\" data-end=\"4363\">3. Lawful Use, Practical Functionality, and Tenant Welfare<\/strong><\/h3>\n<p data-start=\"4365\" data-end=\"4564\">The communal room serves a <strong data-start=\"4392\" data-end=\"4411\">shared function<\/strong> among tenants and the furniture in question \u2014 namely a wardrobe and chest of drawers \u2014 enhances the <strong data-start=\"4512\" data-end=\"4525\">usability<\/strong> and <strong data-start=\"4530\" data-end=\"4547\">functionality<\/strong> of the space by:<\/p>\n<ul data-start=\"4566\" data-end=\"4818\">\n<li data-start=\"4566\" data-end=\"4689\">\n<p data-start=\"4568\" data-end=\"4689\">Providing <strong data-start=\"4578\" data-end=\"4598\">overflow storage<\/strong> capacity for tenants who may have insufficient personal storage in their individual rooms;<\/p>\n<\/li>\n<li data-start=\"4690\" data-end=\"4818\">\n<p data-start=\"4692\" data-end=\"4818\">Allowing tenants to safely and neatly store personal items that would otherwise clutter their living areas or communal spaces.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4820\" data-end=\"4957\">In the context of HMO living, where private room sizes can be limited, <strong data-start=\"4891\" data-end=\"4911\">overflow storage<\/strong> in communal areas is critical to maintaining:<\/p>\n<ul data-start=\"4959\" data-end=\"5293\">\n<li data-start=\"4959\" data-end=\"5015\">\n<p data-start=\"4961\" data-end=\"5015\">A <strong data-start=\"4963\" data-end=\"4971\">safe<\/strong>, <strong data-start=\"4973\" data-end=\"4981\">tidy<\/strong>, and <strong data-start=\"4987\" data-end=\"5014\">uncluttered environment<\/strong>;<\/p>\n<\/li>\n<li data-start=\"5016\" data-end=\"5114\">\n<p data-start=\"5018\" data-end=\"5114\">The tenants\u2019 ability to enjoy <strong data-start=\"5048\" data-end=\"5068\">adequate storage<\/strong> without overcrowding their sleeping quarters;<\/p>\n<\/li>\n<li data-start=\"5115\" data-end=\"5293\">\n<p data-start=\"5117\" data-end=\"5293\"><strong data-start=\"5117\" data-end=\"5145\">Psychological well-being<\/strong>, by reducing clutter and disorganization, both of which are recognised under the <strong data-start=\"5227\" data-end=\"5236\">HHSRS<\/strong> as potential causes of stress and mental health hazards.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5295\" data-end=\"5636\"><strong data-start=\"5295\" data-end=\"5508\">Crucially, depriving tenants of this storage furniture would not only diminish the functionality of the house but would also make it substantially more difficult to keep the communal areas tidy and hazard-free<\/strong>, directly contravening the landlord\u2019s duties under <strong data-start=\"5560\" data-end=\"5576\">Regulation 6<\/strong> to maintain the common areas in a clean and safe condition.<\/p>\n<p data-start=\"5638\" data-end=\"5759\">Therefore, by demanding the removal of the wardrobe and drawers, the council is actually requesting a measure that would:<\/p>\n<ul data-start=\"5760\" data-end=\"6133\">\n<li data-start=\"5760\" data-end=\"5807\">\n<p data-start=\"5762\" data-end=\"5807\"><strong data-start=\"5762\" data-end=\"5790\">Reduce the functionality<\/strong> of the property;<\/p>\n<\/li>\n<li data-start=\"5808\" data-end=\"5873\">\n<p data-start=\"5810\" data-end=\"5873\"><strong data-start=\"5810\" data-end=\"5872\">Increase the risk of untidiness, clutter, and trip hazards<\/strong>;<\/p>\n<\/li>\n<li data-start=\"5874\" data-end=\"5935\">\n<p data-start=\"5876\" data-end=\"5935\"><strong data-start=\"5876\" data-end=\"5923\">Exacerbate psychological and physical risks<\/strong> to tenants;<\/p>\n<\/li>\n<li data-start=\"5936\" data-end=\"6133\">\n<p data-start=\"5938\" data-end=\"6133\"><strong data-start=\"5938\" data-end=\"5987\">Directly undermine the landlord\u2019s obligations<\/strong> to ensure that the property is maintained to a legally compliant standard under the <strong data-start=\"6072\" data-end=\"6092\">Housing Act 2004<\/strong> and <strong data-start=\"6097\" data-end=\"6132\">HMO Management Regulations 2006<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"6135\" data-end=\"6138\" \/>\n<h3 data-start=\"6140\" data-end=\"6183\"><strong data-start=\"6144\" data-end=\"6183\">4. Overreach and Ultra Vires Action<\/strong><\/h3>\n<p data-start=\"6185\" data-end=\"6388\">It is a well-established principle of public law that a public body may only exercise those powers which are explicitly granted to it by statute (<em data-start=\"6331\" data-end=\"6370\">Attorney General v Fulham Corporation<\/em> [1921] 1 Ch 440).<\/p>\n<p data-start=\"6390\" data-end=\"6528\">Where an authority acts <strong data-start=\"6414\" data-end=\"6445\">without statutory authority<\/strong>, its actions are <strong data-start=\"6463\" data-end=\"6478\">ultra vires<\/strong> (beyond its legal powers) and hence <strong data-start=\"6515\" data-end=\"6527\">unlawful<\/strong>.<\/p>\n<p data-start=\"6530\" data-end=\"6769\">Since there is no provision in the applicable law authorising the council to dictate the removal of wardrobes and drawers in communal areas, such a demand would be an act <strong data-start=\"6701\" data-end=\"6742\">beyond the council\u2019s statutory powers<\/strong> and would be <strong data-start=\"6756\" data-end=\"6768\">unlawful<\/strong>.<\/p>\n<p data-start=\"6771\" data-end=\"6891\">Should the council attempt to enforce such a demand without clear legal basis, it would expose itself to a challenge by:<\/p>\n<ul data-start=\"6892\" data-end=\"7010\">\n<li data-start=\"6892\" data-end=\"6954\">\n<p data-start=\"6894\" data-end=\"6954\">Appeal to the <strong data-start=\"6908\" data-end=\"6950\">First-tier Tribunal (Property Chamber)<\/strong>, or<\/p>\n<\/li>\n<li data-start=\"6955\" data-end=\"7010\">\n<p data-start=\"6957\" data-end=\"7010\"><strong data-start=\"6957\" data-end=\"6976\">Judicial Review<\/strong> for acting outside of its powers.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"7012\" data-end=\"7015\" \/>\n<h3 data-start=\"7017\" data-end=\"7065\"><strong data-start=\"7021\" data-end=\"7065\">5. Breach of Landlord\u2019s Statutory Duties<\/strong><\/h3>\n<p data-start=\"7067\" data-end=\"7139\">Complying with the council\u2019s request would likely cause the landlord to:<\/p>\n<ul data-start=\"7141\" data-end=\"7474\">\n<li data-start=\"7141\" data-end=\"7282\">\n<p data-start=\"7143\" data-end=\"7282\">Breach <strong data-start=\"7150\" data-end=\"7169\">Regulation 4(3)<\/strong> of the HMO Management Regulations by failing to take reasonable steps to protect occupiers from injury and harm;<\/p>\n<\/li>\n<li data-start=\"7283\" data-end=\"7474\">\n<p data-start=\"7285\" data-end=\"7474\">Fail to maintain the property in a condition that minimises risks under the <strong data-start=\"7361\" data-end=\"7370\">HHSRS<\/strong>, such as those related to lack of sufficient storage, cluttered environments, and psychological stress.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"7476\" data-end=\"7709\">Removing valuable storage space would therefore be <strong data-start=\"7527\" data-end=\"7589\">inconsistent with the landlord\u2019s positive statutory duties<\/strong> and would potentially <strong data-start=\"7612\" data-end=\"7651\">expose tenants to increased hazards<\/strong> \u2014 a direct contradiction of the Housing Act\u2019s objectives.<\/p>\n<hr data-start=\"7711\" data-end=\"7714\" \/>\n<h3 data-start=\"7716\" data-end=\"7737\"><strong data-start=\"7720\" data-end=\"7737\">6. Conclusion<\/strong><\/h3>\n<ul data-start=\"7739\" data-end=\"8570\">\n<li data-start=\"7739\" data-end=\"7864\">\n<p data-start=\"7741\" data-end=\"7864\">There is <strong data-start=\"7750\" data-end=\"7772\">no statutory basis<\/strong> empowering the council to mandate the removal of wardrobes or drawers from a communal room;<\/p>\n<\/li>\n<li data-start=\"7865\" data-end=\"7953\">\n<p data-start=\"7867\" data-end=\"7953\">The request constitutes an <strong data-start=\"7894\" data-end=\"7916\">unlawful overreach<\/strong> of the council\u2019s enforcement powers;<\/p>\n<\/li>\n<li data-start=\"7954\" data-end=\"8239\">\n<p data-start=\"7956\" data-end=\"8060\">Complying with the request would likely place the landlord <strong data-start=\"8015\" data-end=\"8053\">in breach of statutory obligations<\/strong> under:<\/p>\n<ul data-start=\"8063\" data-end=\"8239\">\n<li data-start=\"8063\" data-end=\"8090\">\n<p data-start=\"8065\" data-end=\"8090\">The <strong data-start=\"8069\" data-end=\"8089\">Housing Act 2004<\/strong>,<\/p>\n<\/li>\n<li data-start=\"8093\" data-end=\"8178\">\n<p data-start=\"8095\" data-end=\"8178\">The <strong data-start=\"8099\" data-end=\"8173\">Management of Houses in Multiple Occupation (England) Regulations 2006<\/strong>, and<\/p>\n<\/li>\n<li data-start=\"8181\" data-end=\"8239\">\n<p data-start=\"8183\" data-end=\"8239\">The <strong data-start=\"8187\" data-end=\"8238\">Housing Health and Safety Rating System (HHSRS)<\/strong>;<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"8240\" data-end=\"8463\">\n<p data-start=\"8242\" data-end=\"8463\">Removal would <strong data-start=\"8256\" data-end=\"8281\">reduce tenant welfare<\/strong>, <strong data-start=\"8283\" data-end=\"8320\">deprive them of essential storage<\/strong>, <strong data-start=\"8322\" data-end=\"8365\">diminish the functionality of the house<\/strong>, <strong data-start=\"8367\" data-end=\"8406\">make tidiness difficult to maintain<\/strong>, and <strong data-start=\"8412\" data-end=\"8432\">increase hazards<\/strong> that the law seeks to prevent;<\/p>\n<\/li>\n<li data-start=\"8464\" data-end=\"8570\">\n<p data-start=\"8466\" data-end=\"8570\">The council\u2019s request is not only <strong data-start=\"8500\" data-end=\"8522\">unsupported by law<\/strong> but <strong data-start=\"8527\" data-end=\"8546\">contrary to law<\/strong> and hence <strong data-start=\"8557\" data-end=\"8569\">unlawful<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"8572\" data-end=\"8575\" \/>\n<p>&nbsp;<\/p>\n<hr data-start=\"9084\" data-end=\"9087\" \/>\n<h3 data-start=\"9089\" data-end=\"9123\"><strong data-start=\"9093\" data-end=\"9123\">Key Legislative References<\/strong><\/h3>\n<ul data-start=\"9124\" data-end=\"9468\">\n<li data-start=\"9124\" data-end=\"9181\">\n<p data-start=\"9126\" data-end=\"9181\"><strong data-start=\"9126\" data-end=\"9146\">Housing Act 2004<\/strong>, including <strong data-start=\"9158\" data-end=\"9180\">Schedule 1 \u2014 HHSRS<\/strong>.<\/p>\n<\/li>\n<li data-start=\"9182\" data-end=\"9291\">\n<p data-start=\"9184\" data-end=\"9291\"><strong data-start=\"9184\" data-end=\"9258\">Management of Houses in Multiple Occupation (England) Regulations 2006<\/strong>, Regulations <strong data-start=\"9272\" data-end=\"9280\">4(3)<\/strong> and <strong data-start=\"9285\" data-end=\"9290\">6<\/strong>.<\/p>\n<\/li>\n<li data-start=\"9292\" data-end=\"9386\">\n<p data-start=\"9294\" data-end=\"9386\"><strong data-start=\"9294\" data-end=\"9335\">Attorney General v Fulham Corporation<\/strong> [1921] 1 Ch 440 (principle of ultra vires action).<\/p>\n<\/li>\n<li data-start=\"9387\" data-end=\"9468\">\n<p data-start=\"9389\" data-end=\"9468\"><strong data-start=\"9389\" data-end=\"9425\">LACORS Fire Safety Guidance 2008<\/strong> (by extension for fire safety principles).<\/p>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Introduction This letter responds to the council\u2019s request for the removal of a wardrobe and chest of drawers from a communal room in an HMO property.
