data-start=\"778\" data-end=\"1001\">A valid <strong data-start=\"786\" data-end=\"845\">updated Electrical Installation Condition Report (EICR)<\/strong> was completed on <strong data-start=\"863\" data-end=\"883\">23 November 2024<\/strong>, and proactively emailed to the inspecting officer on <strong data-start=\"938\" data-end=\"958\">12 December 2024<\/strong> \u2014 <strong obstructions.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1194\" data-end=\"1692\">\n<p class=\"\" data-start=\"1196\" data-end=\"1307\">My email included reasonable, detailed questions seeking clarification on <strong data-start=\"1270\" data-end=\"1296\">specific points of law<\/strong> \u2014 such as:<\/p>\n<ul data-start=\"1310\" data-end=\"1692\">\n<li class=\"\" data-start=\"1310\" data-end=\"1383\">\n<p class=\"\" data-start=\"1312\" data-end=\"1383\">Whether a consumer unit must legally be boxed in if already metal-clad;<\/p>\n<\/li>\n<li class=\"\" data-start=\"1386\" verification.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"897\" data-end=\"937\"><strong data-start=\"897\" data-end=\"936\">Subsequent Events Confirm the Error<\/strong>:<\/p>\n<ul data-start=\"938\" data-end=\"1286\">\n<li class=\"\" data-start=\"938\" data-end=\"1083\">\n<p class=\"\" data-start=\"940\" data-end=\"1083\">During the\u00a0<strong data-start=\"951\" its content or adequacy.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1152\" data-end=\"1286\">\n<p class=\"\" data-start=\"1154\" data-end=\"1286\">This proves that the original allegation was not the result of actual deficiency, but rather of\u00a0<strong data-start=\"1250\" data-end=\"1285\">failure to investigate properly<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"1288\" data-end=\"1326\"><strong data-start=\"1288\" data-end=\"1325\">Legal and Procedural Implications<\/strong>:<\/p>\n<ul data-start=\"1327\" data-end=\"1918\">\n<li class=\"\" data-start=\"1327\" data-end=\"1514\">\n<p class=\"\" data-start=\"1329\" data-end=\"1514\">Under Article 9(6) of the Regulatory Reform (Fire Safety) Order 2005, it is the duty of the enforcing authority to\u00a0<strong shortfall also breaches the\u00a0<strong data-start=\"1721\" data-end=\"1741\">Regulators\u2019 Code<\/strong>, which mandates that enforcement action should be preceded by\u00a0<strong data-start=\"1804\" data-end=\"1873\">engagement, clear guidance, and opportunity to comply voluntarily<\/strong>, especially where no imminent danger exists.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"1920\" data-end=\"1935\"><strong data-start=\"1920\" data-end=\"1934\">Final Words on this deficiency<\/strong><\/p>\n<ul data-start=\"1936\" data-end=\"2444\">\n<li class=\"\" data-start=\"1936\" data-end=\"2035\">\n<p class=\"\" data-start=\"1938\" data-end=\"2035\">The Article 9 allegation was materially false, procedurally improper, and strategically reckless.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2036\" data-end=\"2230\">\n<p class=\"\" data-start=\"2038\" data-end=\"2230\">It contributed directly to an unnecessary enforcement process, legal data-end=\"2325\">premature enforcement based on assumption rather than fact<\/strong>, and any resulting costs must be seen as\u00a0<strong data-start=\"2367\" data-end=\"2443\">a direct consequence of the Authority\u2019s failure to follow lawful process<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<h3 class=\"\" data-start=\"3567\" data-end=\"3615\">\u00a0<strong data-start=\"3574\" data-end=\"3615\"><em>Article 11 \u2013 Fire Safety Arrangements<\/em><\/strong><\/h3>\n<p>&nbsp;<\/p>\n<p class=\"\" data-start=\"3616\" data-end=\"3677\"><strong data-start=\"3616\" data-end=\"3630\">Allegation<\/strong>: No documented emergency plan or arrangements.<\/p>\n<p class=\"\" data-start=\"3679\" data-end=\"3692\"><strong data-start=\"3679\" data-end=\"3691\">Rebuttal<\/strong>:<\/p>\n<ul data-start=\"3693\" data-end=\"3954\">\n<li class=\"\" data-start=\"3693\" data-end=\"3789\">\n<p class=\"\" data-start=\"3695\" data-start=\"3790\" data-end=\"3876\">\n<p class=\"\" data-start=\"3792\" data-end=\"3876\">These materials were presented during the second inspection and deemed satisfactory.<\/p>\n<\/li>\n<li class=\"\" data-start=\"3877\" data-end=\"3954\">\n<h4 data-start=\"3879\" data-end=\"3954\">Again,\u00a0<strong data-start=\"3886\" data-end=\"3953\">no opportunity was given to present this prior to formal action<\/strong>.<\/h4>\n<h4 data-start=\"3879\" data-end=\"3954\"><\/h4>\n<h4><a Equipment<\/strong><\/em><\/h3>\n<p>&nbsp;<\/p>\n<p class=\"\" data-start=\"1732\" data-end=\"1806\"><strong data-start=\"1732\" data-end=\"1746\">Allegation<\/strong>: That no fire extinguishers or fire blankets were provided.<\/p>\n<p class=\"\" data-start=\"1808\" data-end=\"1821\"><strong data-start=\"1808\" data-end=\"1820\">Rebuttal<\/strong>:<\/p>\n<ul data-start=\"1823\" data-end=\"2438\">\n<li class=\"\" data-start=\"1927\" data-end=\"2014\">\n<p class=\"\" data-start=\"1929\" data-end=\"2014\"><strong data-start=\"1929\" data-end=\"1975\">Fire blankets were placed in kitchen areas<\/strong>, as per standard HMO safety practices. ( But due to some maintenance issue in the kitchen, removed temporarily, but it was reinstated immediately after work was done)<\/p>\n<\/li>\n<li class=\"\" data-start=\"2271\" data-end=\"2438\">\n<p class=\"\" data-start=\"2273\" data-end=\"2438\">At the\u00a0<strong data-start=\"2280\" data-end=\"2318\">follow-up inspection in April 2025<\/strong>, the equipment was found in place, and <strong data-start=\"2357\" data-end=\"2384\">no objection was raised<\/strong>, confirming there was no substantive non-compliance.<\/p>\n<\/li>\n<\/ul>\n<blockquote>\n<p class=\"\" data-start=\"358\" data-end=\"536\">Under Lincolnshire Fire and Rescue\u2019s own approach \u2014 consistent with LACORS guidance \u2014\u00a0<strong data-start=\"444\" data-end=\"492\">fire extinguishers are not mandatory in HMOs<\/strong>\u00a0where tenants are not trained in their use.<\/p>\n<p class=\"\" data-start=\"538\" data-end=\"697\">Despite this, we\u00a0<strong data-start=\"555\" data-end=\"613\">voluntarily installed fire extinguishers on each floor<\/strong>\u00a0after receiving the Enforcement Notice, to exceed expectations and fully cooperate.<\/p>\n<p class=\"\" data-start=\"699\" data-end=\"790\">At no point did the inspector request clarification or check whether provision was planned.<\/p>\n<p class=\"\" data-start=\"792\" data-end=\"930\">This enforcement item was based on assumption, not law or guidance, and was\u00a0<strong data-start=\"868\" data-end=\"901\">satisfied by voluntary action<\/strong>\u00a0that went beyond legal duty.<\/p>\n<p data-start=\"792\" data-end=\"930\"><a href=\"https:\/\/i0.wp.com\/areton-ltd.com\/Aretonoldbackup\/wp-content\/uploads\/2025\/05\/Fire-extinguish.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-12267\" src=\"https:\/\/i0.wp.com\/areton-ltd.com\/Aretonoldbackup\/wp-content\/uploads\/2025\/05\/Fire-extinguish.jpg?resize=1200%2C1600&#038;ssl=1\" alt=\"\" width=\"1200\" height=\"1600\" srcset=\"https:\/\/i0.wp.com\/areton-ltd.com\/Aretonoldbackup\/wp-content\/uploads\/2025\/05\/Fire-extinguish.jpg?w=1200&amp;ssl=1 1200w, https:\/\/i0.wp.com\/areton-ltd.com\/Aretonoldbackup\/wp-content\/uploads\/2025\/05\/Fire-extinguish.jpg?resize=225%2C300&amp;ssl=1 225w, https:\/\/i0.wp.com\/areton-ltd.com\/Aretonoldbackup\/wp-content\/uploads\/2025\/05\/Fire-extinguish.jpg?resize=768%2C1024&amp;ssl=1 768w, https:\/\/i0.wp.com\/areton-ltd.com\/Aretonoldbackup\/wp-content\/uploads\/2025\/05\/Fire-extinguish.jpg?resize=1152%2C1536&amp;ssl=1 1152w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/a><\/p>\n<\/blockquote>\n<h3 class=\"\" data-start=\"4325\" data-end=\"4375\"><strong data-start=\"4332\" data-end=\"4375\">Article 14 \u2013 Emergency Routes and Exits<\/strong><\/h3>\n<p class=\"\" data-start=\"4376\" data-end=\"4451\"><strong data-start=\"4376\" data-end=\"4390\">Allegation<\/strong>: Obstructed escape routes (bins, fridge\/freezers, DB board).<\/p>\n<p class=\"\" data-start=\"4453\" data-end=\"4466\"><strong data-start=\"4453\" data-end=\"4465\">Rebuttal<\/strong>:<\/p>\n<ul data-start=\"4467\" data-end=\"4942\">\n<li class=\"\" data-start=\"4467\" data-end=\"4626\">\n<p class=\"\" data-start=\"4469\" data-end=\"4626\">The alleged obstructions (bins, etc.) were\u00a0<strong data-start=\"4512\" data-end=\"4532\">minor, temporary<\/strong>, and in fact\u00a0<strong data-start=\"4546\" data-end=\"4590\">removed immediately following inspection<\/strong>, acknowledged in the report itself.<\/p>\n<\/li>\n<li class=\"\" data-start=\"4627\" data-end=\"4867\">\n<p class=\"\" data-start=\"4629\" data-end=\"4867\">The\u00a0<strong data-start=\"4633\" data-end=\"4664\">electric distribution board<\/strong>\u00a0was installed in compliance with electrical regulations. Its position had\u00a0<strong data-start=\"4739\" data-end=\"4797\">never been identified as a hazard in prior inspections<\/strong>, including multiple visits by Lincolnshire City Council HMO officers. ( But we took initiative to follow the recommendation of fire authorities to boxed in the distribution board )<\/p>\n<\/li>\n<li class=\"\" data-start=\"4868\" data-end=\"4942\">\n<p class=\"\" data-start=\"4870\" data-end=\"4942\">No fire load or escape time study was conducted to justify this finding.<\/p>\n<\/li>\n<\/ul>\n<blockquote>\n<p class=\"\" data-start=\"4944\" data-end=\"5029\"><span style=\"color: #ff6600;\">This allegation was exaggerated and resolved before any enforcement timeline expired<\/span><\/p>\n<p data-start=\"4944\" data-end=\"5029\"><span style=\"color: #ff6600;\">Therefore, due to the fact that this was done there and then, it should not be included in an enforcement notice. The distribution board is made of metal, and it has been boxed in, even if this is not required. A simple request would have sufficed, given my proven compliance.<\/span><\/p>\n<\/blockquote>\n<h3 class=\"\" data-start=\"5036\" data-end=\"5097\"><em><strong data-start=\"5043\" data-end=\"5097\">Article 17 \u2013 Maintenance of Fire Alarm and Emergency Lighting<br \/>\n<\/strong><br \/>\n<\/em><\/h3>\n<p class=\"\" data-start=\"5098\" data-end=\"5187\"><strong data-start=\"5098\" data-end=\"5112\">Allegation<\/strong>: Inadequate maintenance of fire alarm, emergency lighting.<\/p>\n<p class=\"\" data-start=\"5189\" data-end=\"5202\"><strong data-start=\"5189\" data-end=\"5201\">Rebuttal<\/strong>:<\/p>\n<ul data-start=\"5203\" data-end=\"5661\">\n<li class=\"\" data-start=\"5203\" data-end=\"5317\">\n<p class=\"\" data-start=\"5205\" data-end=\"5317\">Contracts for\u00a0<strong data-start=\"5219\" data-end=\"5268\">fire alarm maintenance and emergency lighting<\/strong>\u00a0checks were in place with qualified contractors.<\/p>\n<\/li>\n<li class=\"\" data-start=\"5318\" data-end=\"5432\">\n<p class=\"\" data-start=\"5320\" data-end=\"5432\"><strong data-start=\"5320\" data-end=\"5332\">Logbooks<\/strong> of weekly and monthly tests were available, but had never been requested by the Authority before enforcement.<\/p>\n<h4><a href=\"https:\/\/areton-ltd.com\/Aretonoldbackup\/wp-content\/uploads\/2025\/05\/FIRE-ALARM-RP-16-1-24.pdf\">Fire Alaram Certification\u00a0<\/a><\/h4>\n<\/li>\n<li data-start=\"5318\" data-end=\"5432\"><a href=\"https:\/\/areton-ltd.com\/Aretonoldbackup\/wp-content\/uploads\/2025\/05\/Emergency-Light-16-01-2024.pdf\">Emergency\u00a0 Lightning\u00a0<\/a><\/li>\n<\/ul>\n<h3><em>DEFICIENCY \u2013 Article 21A<\/em><\/h3>\n<p>Relevant information has not been shared with tenants<\/p>\n<ul>\n<li>The Authority never asked to see this material and simply presumed its absence<\/li>\n<\/ul>\n<h4><a href=\"https:\/\/areton-ltd.com\/Aretonoldbackup\/wp-content\/uploads\/2025\/05\/Tenant-Information.pdf\">Click here to see the documents related to Article 21A<\/a><\/h4>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rebuttal to Article 8 \u2013 General Fire Precautions Allegation: That general fire precautions, including electrical safety and escape route arrangements, were not adequately implemented.
