emergency sleeping accommodation for 4 to 5 days with no rental income from it.<\/h2>\n<p>&nbsp;<\/p>\n<h2 class=\"\" data-start=\"312\" data-end=\"391\">1. <strong data-start=\"320\" data-end=\"391\">Short-term or incidental use is not \u201cuse as sleeping accommodation\u201d<\/strong><\/h2>\n<p class=\"\" data-start=\"392\" data-end=\"460\">In housing law and licensing appeals, tribunals distinguish between:<\/p>\n<ul data-start=\"462\" data-end=\"569\">\n<li class=\"\" data-start=\"462\" data-end=\"510\">\n<p class=\"\" data-start=\"464\" data-end=\"510\"><strong data-start=\"464\" data-end=\"510\">Temporary or incidental presence in a room<\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"511\" data-end=\"569\">\n<p class=\"\" data-start=\"513\" data-end=\"569\">vs. <strong data-start=\"517\" data-end=\"569\">Regular or ongoing use as sleeping accommodation<\/strong><\/p>\n<\/li>\n<\/ul>\n<h3 class=\"\" data-start=\"571\" (Gaskin) v Richmond LBC [2018] UKUT 198 (LC)<\/strong><\/p>\n<blockquote data-start=\"647\" data-end=\"826\">\n<p class=\"\" data-start=\"649\" data-end=\"826\">The Upper Tribunal confirmed that use of rooms for sleeping accommodation must be assessed <strong data-start=\"740\" data-end=\"772\">functionally and practically<\/strong>, not just whether someone lay there for a short time.<\/p>\n<\/blockquote>\n<h3 class=\"\" data-start=\"828\" data-end=\"849\">\ud83d\udd39 Implication:<\/h3>\n<p class=\"\" data-start=\"850\" data-end=\"1043\">If the room was not <strong data-start=\"870\" data-end=\"896\">designated or intended<\/strong> for sleeping, and used <strong data-start=\"920\" data-end=\"941\">only in emergency<\/strong> for a <strong data-start=\"948\" data-end=\"969\">very short period<\/strong>, it does not qualify as a <strong data-start=\"996\" data-end=\"1042\">breach of sleeping accommodation standards<\/strong>.<\/p>\n<hr class=\"\" data-start=\"1045\" data-end=\"1048\" \/>\n<h2 class=\"\" data-start=\"1050\" data-end=\"1142\">\u2705 2. <strong data-start=\"1058\" data-end=\"1142\">Proportionality matters: Civil penalties must reflect genuine harm or misconduct<\/strong><\/h2>\n<h3 class=\"\" data-start=\"1144\" data-end=\"1171\">\ud83d\udd39 <strong data-start=\"1151\" data-end=\"1168\">Key principle<\/strong>:<\/h3>\n<p class=\"\" data-start=\"1172\" data-end=\"1390\"><strong data-start=\"1172\" data-end=\"1204\">Haringey LBC v Simawi (2021)<\/strong><br data-start=\"1204\" data-end=\"1207\" \/>\u2013 Courts have reiterated that <strong data-start=\"1237\" data-end=\"1274\">enforcement must be proportionate<\/strong>, and regulatory decisions (including penalties) are <strong data-start=\"1327\" gained.<\/p>\n<\/blockquote>\n<hr class=\"\" data-start=\"1542\" data-end=\"1545\" \/>\n<h2 class=\"\" data-start=\"1547\" data-end=\"1638\">\u2705 3. <strong data-start=\"1555\" data-end=\"1638\">Tribunals regularly reject penalties for minor, isolated, or technical breaches<\/strong><\/h2>\n<h3 class=\"\" data-start=\"1640\" data-end=\"1657\">\ud83d\udd39 Example:<\/h3>\n<p class=\"\" data-start=\"1658\" data-end=\"1777\"><strong data-start=\"1658\" data-end=\"1712\">London Borough of Waltham Forest v Marshall [2021]<\/strong><br data-start=\"1712\" data-end=\"1715\" \/>\u2013 The First-tier Tribunal <strong data-start=\"1741\" data-end=\"1770\">cancelled a civil penalty<\/strong> where:<\/p>\n<ul data-start=\"1778\" data-end=\"1898\">\n<li class=\"\" data-start=\"1778\" data-end=\"1820\">\n<p class=\"\" data-start=\"1780\" data-end=\"1820\">Breaches were <strong data-start=\"1794\" data-end=\"1820\">isolated and rectified<\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"1821\" data-end=\"1864\">\n<p class=\"\" data-start=\"1823\" data-end=\"1864\">There was <strong data-start=\"1833\" data-end=\"1864\">no significant risk or harm<\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"1865\" data-end=\"1898\">\n<p class=\"\" data-start=\"1867\" data-end=\"1898\">The landlord <strong data-start=\"1880\" data-end=\"1898\">acted promptly<\/strong><\/p>\n<\/li>\n<\/ul>\n<h3 class=\"\" data-start=\"1900\" data-end=\"1919\">\ud83d\udd39 Key quote:<\/h3>\n<blockquote data-start=\"1920\" data-end=\"2063\">\n<p class=\"\" data-start=\"1922\" data-end=\"2063\">\u201cThe civil penalty regime is not designed to punish technical or fleeting breaches that are corrected and cause no material harm to tenants.\u201d<\/p>\n<\/blockquote>\n<hr class=\"\" data-start=\"2065\" data-end=\"2068\" \/>\n<h2 class=\"\" data-start=\"2070\" data-end=\"2136\">\u2705 4. <strong data-start=\"2078\" data-end=\"2136\">Regulators&#8217; Code (2014) is enforceable policy guidance<\/strong><\/h2>\n<p class=\"\" data-start=\"2138\" data-end=\"2228\">Even if not a court case, councils <strong data-start=\"2173\" data-end=\"2188\">must follow<\/strong> the <strong data-start=\"2193\" data-end=\"2213\">Regulators\u2019 Code<\/strong>, which states:<\/p>\n<blockquote data-start=\"2229\" data-end=\"2387\">\n<p class=\"\" data-start=\"2231\" data-end=\"2387\">\u201cRegulators should ensure their approach is proportionate to the harm or risk&#8230; and support those they regulate to comply before resorting to enforcement.\u201d<\/p>\n<\/blockquote>\n<h1 data-start=\"2389\" data-end=\"2549\"><strong>5 Failure to notify the responsible person\u00a0 of the issue, or raise it after the fact in an interview under caution, may breach this code and weaken the enforceability of any penalty.<\/strong><\/h1>\n<p>&nbsp;<\/p>\n<h2 class=\"\" data-start=\"317\" data-end=\"344\">1. <strong data-start=\"325\" data-end=\"344\">Key Legislation<\/strong><\/h2>\n<h3 class=\"\" data-start=\"346\" data-end=\"374\">\ud83c\udfdb\ufe0f <strong data-start=\"354\" data-end=\"374\">Housing Act 2004<\/strong><\/h3>\n<ul data-start=\"375\" data-end=\"689\">\n<li class=\"\" data-start=\"375\" data-end=\"468\">\n<p class=\"\" data-start=\"377\" data-end=\"468\"><strong data-start=\"377\" breaches licence conditions<\/p>\n<\/li>\n<li class=\"\" data-start=\"570\" data-end=\"689\">\n<p class=\"\" data-start=\"572\" data-end=\"689\"><strong data-start=\"572\" data-end=\"586\">Section 67<\/strong> \u2013 Permits licence conditions on room use, but interpretation must be <strong data-start=\"656\" data-end=\"689\">proportionate and justifiable<\/strong><\/p>\n<\/li>\n<\/ul>\n<blockquote data-start=\"691\" data-end=\"891\">\n<p class=\"\" data-start=\"693\" data-end=\"891\">\ud83e\udde0 If the communal room was <strong data-start=\"721\" data-end=\"732\">not let<\/strong>, <strong data-start=\"734\" data-end=\"763\">not intended for sleeping<\/strong>, and was used <strong data-start=\"778\" data-end=\"797\">without payment<\/strong>, it is unlikely to fall under \u201cuse as sleeping accommodation\u201d in the formal sense of the Act.<\/p>\n<\/blockquote>\n<hr class=\"\" data-start=\"893\" data-end=\"896\" \/>\n<h2 class=\"\" data-start=\"898\" data-end=\"974\">\u2705 2. <strong data-start=\"906\" data-end=\"974\">City of Lincoln Council Enforcement Policy &amp; Licensing Standards<\/strong><\/h2>\n<h3 class=\"\" data-start=\"976\" data-end=\"1047\">\ud83d\udcdc <strong data-start=\"983\" data-end=\"1047\">Lincoln City Council \u2013 HMO Mandatory Licensing Scheme (2018)<\/strong><\/h3>\n<ul>\n<li class=\"\" data-start=\"1049\" data-end=\"1201\">\n<p class=\"\" data-start=\"1051\" data-end=\"1201\"><strong data-start=\"1051\" data-end=\"1164\">\u201cThe council is committed to dealing with enforcement matters in a fair, transparent, and consistent manner.\u201d<\/strong><\/p>\n<\/li>\n<li data-start=\"1049\" data-end=\"1201\"><strong data-start=\"1205\" data-end=\"1278\">Council should seek to resolve issues informally before formal action<\/strong> (i.e. penalty notices)<\/li>\n<li class=\"\" data-start=\"1340\" data-end=\"1429\">\n<p class=\"\" data-start=\"1342\" data-end=\"1429\">Licence conditions apply to <strong data-start=\"1370\" data-end=\"1395\">habitual use of rooms<\/strong>, not incidental or emergency use.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1431\" data-end=\"1634\">\n<p class=\"\" data-start=\"1433\" data-end=\"1634\">\u201cThe licence holder shall ensure any room in the HMO used as sleeping accommodation is not used by more than the maximum number of persons specified in the licence\u201d<\/p>\n<\/li>\n<\/ul>\n<p>\ud83e\udde0 If the room <strong data-start=\"1653\" data-end=\"1688\">was not designated for sleeping<\/strong> under the licence and was used <strong data-start=\"1720\" data-end=\"1751\">briefly and without payment<\/strong>, there is <strong data-start=\"1762\" data-end=\"1809\">no breach of a habitual licensing condition<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<h2 class=\"\" data-start=\"1817\" data-end=\"1858\">3. <strong data-start=\"1825\" data-end=\"1858\">Regulators\u2019 Code (BEIS, 2014)<\/strong><\/h2>\n<ul data-start=\"1860\" data-end=\"2194\">\n<li class=\"\" data-start=\"1860\" data-end=\"1907\">\n<p class=\"\" data-start=\"1862\" data-end=\"1907\"><strong data-start=\"1862\" data-end=\"1907\">Enforcement must be proportionate to risk<\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"1908\" data-end=\"2028\">\n<p class=\"\" data-start=\"1910\" data-end=\"1927\">Authorities must:<\/p>\n<blockquote data-start=\"1930\" data-end=\"2028\">\n<p class=\"\" data-start=\"1932\" data-end=\"2028\">\u201cSupport those they regulate to comply, and ensure action is proportionate to the harm or risk.\u201d<\/p>\n<\/blockquote>\n<\/li>\n<li class=\"\" data-start=\"2030\" data-end=\"2194\">\n<p class=\"\" data-start=\"2032\" data-end=\"2194\">Using a <strong data-start=\"2040\" data-end=\"2104\">civil penalty for an incidental, short-term humanitarian act<\/strong> (e.g., accommodating someone for a few days due to emergency) is <strong data-start=\"2170\" data-end=\"2194\">contrary to the Code<\/strong><\/p>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2 class=\"\" data-start=\"2201\" data-end=\"2244\">4. <strong data-start=\"2209\" data-end=\"2244\">Case Law and Tribunal Decisions<\/strong><\/h2>\n<h3 class=\"\" data-start=\"2246\" data-end=\"2299\">\ud83d\udd39 <strong data-start=\"2253\" data-end=\"2299\">Gaskin v Richmond LBC (2021)<\/strong> \u2013 FTT<\/h3>\n<ul data-start=\"2502\" data-end=\"2760\">\n<li class=\"\" data-start=\"2502\" data-end=\"2604\">\n<p class=\"\" data-start=\"2504\" data-end=\"2604\">Civil penalty was cancelled where the landlord\u2019s breach was <strong data-start=\"2564\" data-end=\"2573\">minor<\/strong>, <strong data-start=\"2575\" data-end=\"2584\">brief<\/strong>, and <strong data-start=\"2590\" data-end=\"2603\">rectified<\/strong>.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2605\" data-end=\"2760\">\n<p class=\"\" data-start=\"2607\" data-end=\"2625\">Tribunal
